Residencyrequirements
ForNewYorkStateSupremeCourttohavejurisdictionovertheparties(seeDomesticRelationsLaw§230)oneofthefollowingresidencyconditionsmustbesatisfied:
ThemarriageceremonywasperformedinNewYorkandeitherspouseisaresidentofthestateatthetimeofthecommencementoftheactionfordivorceandresidedinthestateforacontinuousperiodofoneyearimmediatelybeforetheactionbegan.
ThecouplelivedashusbandandwifeinNewYorkandeitherspouseisaresidentofthestateatthetimeofthecommencementoftheactionfordivorceandresidedinthisstateforacontinuousperiodofoneyearimmediatelybeforetheactionbegan.
ThegroundsfordivorceoccurredinNewYorkandeitherspouseisaresidentofthestateatthetimeofthecommencementoftheactionfordivorceandresidedinthestateforacontinuousperiodofoneyearimmediatelybeforetheactionbegan.
ThegroundsfordivorceoccurredinNewYorkandbothspousesareNewYorkresidentsatthetimetheactioniscommenced.
IfthepartiesweremarriedoutsideofNewYorkandhaveneverlivedtogetherashusbandandwifeinthestateandthegroundsfordivorcedidnotoccurinNewYorkthen,onespousemustpresentlybearesidentofNewYorkandhaveresidedcontinuouslyinthestateforatleasttwoyearspriortofilinganactionfordivorce.
Residing"continuously"inthestatedoesnotmeanthatthepartycannothaveleftthestateduringtheperiodofresidencynordoesitmeanthatthepartydoesnothaveanotherresidenceelsewhereoutsideNewYork.
